Chance to Challenge Dismissed Traffic Tickets Begins
As of August 23, 2014, motor carriers and drivers are able to request the removal of roadside inspection violations from agency data systems to more accurately reflect outcomes of judicial proceedings.
The Federal Motor Carrier Safety Administration (FMCSA) has emphasized that the request only applies to citations issued on or after August 23, 2014, and is not retroactive. The updated policy enables carriers and drivers to request, through the DataQs system, the removal of violations that were previously uploaded into FMCSA’s Motor Carrier Management Information System (MCMIS) by state enforcement agencies when a driver is found not guilty or if a violation is dismissed in court.
However, any violation that results in a fine or paying court costs will not be amended in the MCMIS data as it does not fit within the scope of an adjudicated violation. Learn more about DataQs.
